Terms of Use

Please read these terms carefully. They include important points about listing accuracy, paper checks, brokerage and introductions.

1. Accepting these terms

These Terms of Use govern your use of westdelhiproperty.com (the “Site”), the Floor Advisor chat, and our related services, operated by West Delhi Properties (“we”, “us”). By using the Site, submitting a form, or engaging our services, you agree to these terms. If you don't agree, please don't use the Site.

2. What we do

We are a real-estate brokerage. We introduce buyers to owners of builder floors and other residential properties in West Delhi and help both sides through visits, negotiation and paperwork. Unless stated otherwise, we are not the owner or developer of any property shown on the Site.

3. Listing information

• Listing details are provided by owners or their representatives and are shared in good faith. Areas, sizes, floor details and features are approximate.
• Prices are asking prices. They may change and are open to negotiation.
• Photographs may be representative and may not show the exact property.
• A listing is not an offer or a contract, and availability is not guaranteed until a written agreement is signed between buyer and owner.

4. Paper checks are not a title guarantee

Before listing, we carry out a preliminary review of key documents to screen out obvious problems. This review is not a legal opinion, a title search report, or a guarantee of title. You must carry out your own independent due diligence, through your own lawyer, before paying any token or advance or signing any agreement. To the extent permitted by law, we are not responsible for defects in title or documents that are not disclosed to us or that a preliminary review would not reasonably reveal.

5. Brokerage

Our brokerage is payable as agreed in writing with you before any site visit, for example in a visit acknowledgement or mandate letter. It may be payable by the buyer, the owner, or both, as agreed. Applicable taxes, including GST, are payable in addition. Browsing the Site, using the Floor Advisor, and sharing your requirements are free.

6. Introductions and non-circumvention

Before any site visit, we ask you to confirm in writing, for example by a signed visit acknowledgement or a WhatsApp confirmation, the brokerage and the introduction terms below. A property is treated as introduced by us when we share its details, location or address with you, or arrange or accompany a visit. Our WhatsApp messages confirming such details or visits are records of the introduction.

If, within 12 months of our introduction, you buy, sell, lease, or otherwise deal in that property, whether directly, through a family member, associate or company connected to you, or through another agent, you agree that our brokerage, as agreed in writing, becomes payable to us. You agree not to contact the owner or buyer we introduced in order to avoid our brokerage.

7. Your responsibilities

• Give us accurate information and keep it up to date.
• Owners confirm they are entitled to sell or authorise the sale of the property, and that the details they provide are accurate.
• Do not submit false enquiries, impersonate anyone, send spam, copy or scrape listings, or interfere with the Site's operation.

8. Floor Advisor

The Floor Advisor is an automated assistant. Its replies are general information to help you get started. They can be incomplete or wrong, and they are not legal, financial, tax or valuation advice. Confirm anything important with our team before acting on it.

9. Communications

By sharing your number, you agree that we may contact you on WhatsApp, by phone, or by SMS about your enquiry, matching properties, and visits. You can ask us to stop at any time by replying STOP on WhatsApp or telling us.

10. Payments and fraud warning

We never ask for token money, advances, OTPs, or bank details through the Site or the Floor Advisor. Any token or advance for a property should be paid only as set out in a written agreement with the owner, after your own due diligence. If anyone asks you to pay into a personal account in our name, please verify with us on +91 7042 7042 95 before paying.

11. Regulatory compliance

Where the Real Estate (Regulation and Development) Act, 2016 or any other law applies to a property or to our services, we comply with its requirements, including displaying registration details where required.

12. Content and intellectual property

The Site's design, text, logo and original content belong to West Delhi Properties. Listing content and photographs are used with the owner's permission. You may not copy or republish them without our written consent.

13. Disclaimers and limitation of liability

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from use of the Site or reliance on its content, and our total liability to you for any claim relating to a transaction is limited to the brokerage we received from you for that transaction. Nothing in these terms limits liability that cannot be limited under Indian law.

14. Indemnity

You agree to compensate us for losses we suffer because you breach these terms, provide false information, or misuse the Site.

15. Governing law

These terms are governed by the laws of India. The courts at New Delhi have exclusive jurisdiction over any dispute arising from them.
